New Force Spokesperson Shalimar Abbuisi Wins Human Rights Case Against Ghana As ECOWAS Court Awards $10,000 In Damages

 In a groundbreaking decision, the ECOWAS Court has ruled in favor of Shalimar Abbuisi, spokesperson for the New Force political movement, in her human rights case against the Republic of Ghana. The court found that Ghana violated her fundamental rights through wrongful arrest, rearrest, and illegal deportation in December 2023.

The ruling, delivered on November 22, 2024, determined that the actions of the Ghana Immigration Service contravened Article 6 of the African Charter on Human and Peoples’ Rights, which guarantees the liberty and security of individuals. As a result, the court ordered the Ghanaian government to compensate Abbuisi with $10,000 (approximately GHC160,000) for the harm caused by these violations.

Abbuisi, a Belgian citizen, was initially arrested on allegations of obtaining a student permit under false pretenses. Despite the State Prosecutor dropping the charges, she was rearrested and deported to Belgium under an Executive Instrument. The court noted the significant damage to her personal and professional reputation resulting from these unlawful actions.

Expressing her relief and joy, Abbuisi shared, “I WON MY COURT CASE AGAINST THE STATE OF GHANA!!! ECOWAS Court rules that the rearrest and detention on 19th December 2023 and eventual deportation of Shalimar Abbuisi was an unlawful violation to liberty. I am vindicated—I thank GOD. This is a beautiful day for humanity; we are writing history.”

Her legal team, led by human rights lawyer Francis-Xavier Sosu and Lawyer Belinda Narkey Quaynor, celebrated the victory. Sosu remarked, “We feel vindicated that the ECOWAS Court has protected the rights of Shalimar.” The New Force political movement also welcomed the decision, reaffirming their commitment to justice and accountability in a democratic society.

This landmark case serves as a powerful reminder of the importance of upholding human rights and the rule of law. It underscores the responsibility of government institutions to respect individual liberties and ensure fair treatment for all.
