The Electoral Commission has been dealt another blow in their never ending legal battles to keep disqualified aspirants from the elections after a High Court judge refused a motion set infront of him by the Commission to recuse himself from the case involving the EC and the NDP.
Justice Eric Kyei Baffour oversaw the case involving the EC and the PPP which was won by the latter, leading to flagbearer Dr Ndoum’s reinstatement into the process after his earlier disqualification.
With the NDP in court with the same case against the EC, calling for their reinstatement in the race, the body filed a motion for Justice Baffour to recuse himself from the case.
But ruling earlier today, the Justice said the fact he ruled against them in the other case does not mean he cannot judge this new case simply on its merits. He therefore refused to grant the EC’s motion and would hear the case on Monday, November 7.
The Electoral Commission last month announced the disqualification of 11 Presidential candidates from contesting the 2016 polls, citing numerous irregularities in their filing documents. Since then, the Commission has faced a torrid time in the courts as first the PPP, then APC, won legal battles to have their disqualifications annulled.
