The judge in this case has set the precedent that every man wishes would be a global ruling.
During the drudgery of a normal work day, the lunch hour is often a welcome distraction. Besides being a period to refill the biological tank, it also has to simultaneously function as a relaxing period. All men, everywhere in the world; have only a few things that truly relax them.
Some decide that thing should be porn. However, it is a practice historically frowned upon in the workplace. Not for an Italian worker though,, who indulged and got fired for his trouble.
According to the Daily Mail, “The legal row started five years ago when a court in Termini Imeresi – near Palermo – found the employee guilty.”
He had been fired by Fiat for viewing porn during his lunch hours; a habit the company thought inhibited his productivity. He had argued that his porn viewing was limited to ‘catching a glimpse’ of a film during his breaks.
Italy’s highest court upheld an earlier ruling by an appeals court, that employees can watch adult movies during their lunch breaks, so long as it did not affect productivity during normal hours.
So in essence Fiat was wrong to have fired the worker based entirely on his watching porn during lunch hours. They would only have had cause if it had occurred during regular office hours.
“The evidence was insufficient to prove that the employee viewed porn during his working hours.” The court said in its verdict.
In another similar case, the court held that smoking weed at work is sufficient grounds for you to get fired.
