Justin Bieber and Usher have been ordered to face a lawsuit brought against them by a unanimous verdict passed by a US appeals court.
Singer De Rico and his partner had sued the pair earlier for the 2010 record, claiming they had ripped off a song of theirs by the same title; but that suit was thrown out last year.
Unfortunately for the two A-list stars, a panel of judges have ruled on appeal that there is merit to De Rico’s complaint, and ordered for the suit to go forward.
“After listening to the Copeland song and the Bieber and Usher songs as wholes, we conclude that their choruses are similar enough and also significant enough that a reasonable jury could find the songs intrinsically similar,” Circuit Judge Pamela Harris wrote for the appeals court- according to Reuters.
De Rico is suing for $10m.
