The KKD Rape Case…Everything You Need to Know | From the Hotel Room to the Court Room

Victim’s letter

Anthony Forson Jnr, counsel for the accused, prayed the court to refuse to commit his client for the crime, arguing that they filed a document dated January 15, which they intended to rely on at the High Court.

“We intend to rely on this” he stated, indicating that the state could not pretend to have no knowledge of the victim’s with­drawal letter for the case to be dis­continued.

According to Mr Forson Jnr, the document was a letter written by the victim, the star prosecution wit­ness, indicating she was no longer interested in the case.

He said in a rape case, the evi­dence of the complainant was para­mount in the determination of the case, and in the situation where the first prosecution witness had with­drawn her interest, there would be no basis for the prosecution.

KKD’s lawyer stated that in the law on rape, there was the scandal and the burden of proof, explaining that in the burden of proof, the complainant must demonstrate before the court, the process of rape and later be cross-examined by the counsel for the accused.

He said the burden of proof would then be shifted to the accused, but in the case of his client, the complainant would not collabo­rate with prosecution for all these processes to take place.

Despite the spirited argument of the defence team, the trial judge committed the rather stunned KKD to stand trial at the High Court.

Mr Forson Jnr nonetheless served notice of a possible appeal, saying, “we intend to contest this ruling.”

An Accra High Court is, howev­er, expected to commence trial of the case on March 18, 2015.

KKD is currently on bail, which he secured at the Human Rights Court on humanitarian grounds in the sum of GHȻ20,000 with two sureties after he had been on a 19- day remand at the Airport Police for the offence.

The court granted the bail because counsel for the accused person filed supplementary affi­davits on January 6 and further affi­davits on January 8, 2015 supported by a medical report.”

  1. A few questions that still remain: Why? Why would a girl her age go about, kissing a man his age? And what of all things made her think it was a good idea to follow him to his hotel room and then into the bathroom?

      • Thank goodness I am not one of those girls. Although, I’m the same age as her, I care more about my freedom, graduating university and exploring the world, rather than chasing men who are old enough to be my father.

        It’s rather sad when you think about it. How easy an affluent person can get someone.

        • Did you read the story??? please if you think your thought process is advanced, not everyone is. Obviously, she didnt think anything of that sort was going to happen in the bathroom with a room filled with people. The story above is a very sad one and the girl must be going through a lot. lets all empathise with Effe and stop this backlash. KKD is an evil person, period!!!!!! How can you do such a cruel thing with a girl who told you it was her first time!! AAAHHHHHH, hmmmmmm i pray the rule of law works and he is put behind bars for good as well as KOD. shameless people

          • I beg your pardon, I did in fact read the article. And I do agree with you that what KKD did was very vile and absolutely wrong but she should have questioned her surroundings. And like you, I hope that he is in fact convicted and locked up.

            One of my friends was in a similar situation and she immediately bolted.

            But this is why I stated the previous comment:

            “The accused and Effe, together with Abena, Benny Blanco and KOD, later took a lift to a suite in the hotel.

            The prosecution said in the living room, the victim and her cousin were offered drinks but they refused, and KKD then went to the washroom, came out, and invited Effe in to help him with his make-up.”

            So what if he is an affluent person? They just met the person and some people that he knows. Why would she and her cousin think it is a good idea to accompany them to their suite?

            It’s probably because I was raised to ask questions rather than going with the flow of things, that’s why.

          • Pt, I agree with you. Am sure Lyn did not read the full story and I guess she is an Angel. We just have to pray that the rule of law works. After reading this story iv realised it was an evil and cruel thing KKD did to the girl and he must face the law. Some of these so called Ghanaian celebrities think they are above the law. May God have mercy on their poor souls!!

          • How am I quick to judge?

            I read the articles of the incident when it was first presented last year and did not form any solid conclusions because I was waiting to hear the whole story first. But I have not come to a solid conclusion but rising up these questions is judging?

            Wow if that is so, then I guess I don’t know anything since some of the commentators are trying to make it seem like I did not pay attention at all.

            It’s common sense to question the situation you’re about to place yourself in and the possible outcomes. I was brought up to question my surroundings and situations and the possible consequences that I might face.

            So trying to see what goes on in my country is something wrong? I’m just stating the questions that some people would possibly ask.

          • She shouldn’t have gone to the room….with “strangers” no matter how influential….but she did….we all make silly mistakes every now and then ….which in her case proved costly….just because she entered his room doesn’t mean she agreed to have s*x with him.

          • I like that Kristina. This Lyn girl needs to get busy with her books. She has no business here since she claims she’s working hard towards her future.

  2. But she should have thought it through. I know that she probably didn’t agree to have s** with him.

    But anyways, I hope he gets prosecuted and jailed.
