Kwaw Kese has been locked in a police cell in Kumasi for some weeks now on a request by the police that they needed more time to establish by forensic examination if the substance Kwaw Kese was arrested for smoking in public was indeed WEED.

During the last Court appearance in Kumasi, Kwaw was remanded in jail to allow the police a little more time to be able to establish this and bring the test result to the presiding judge—and today, it has been confirmed by Police prosecutor-Richard Where that; the substance Kwaw was arrested in Kumasi for smoking is indeed WEED.

According to the existing Ghanaian law in relation to the smoking or possession of weed, an arrested person can be sentenced to about 10years in prison—and the smoking of such a substance in public with gross impunity is also a difference offence under section 58 of the Public Health Act 2012 (popularly known as Act 851).

Now that the forensic test is in, Kwaw Kese’s next court appearance on 22 December, 2014 (that is if bail is not secured before then) may see the Ghanaian musician being convicted and sentenced.

The judge could temper justice with mercy by throwing him into jail for 6 or less months or just slap him with a reasonable fine—but remember, he can throw him into jail for as long as 10 years that is if there is no effective defence to the crime.

Surely, it looks like Kwaw Kese has bitten more than he can chew…

Earlier today, in line with our projection, Kwaw’s legal team made an application to a Kumasi High Court, requesting for a bail to be granted on health grounds but the court threw out the case—saying, the lawyer even failed to produce a medical report to support the bail request
