
From what I know, Mzbel has been charged with ‘obstructing a police officer from executing a lawful duty and assaulting a police officer’, the latter charge is a serious criminal offence in law which can easily fetch Mzbel some ‘considerable’ months in prison should the court fail to temper Justice with Mercy…
As I mentioned in my previous post, though Assault is a serious criminal offence, it is one of the crimes that we can easily commit in our day to day life. For you to commit an assault in law, all you have to do is intentionally or recklessly cause another to apprehend the application of imminent unlawful force.
What this means is that, you do not have to hit or touch a person to commit an assault. If you intentionally or recklessly act as though you were going to hit someone and the said someone immediately apprehends that you are going to hit him/her, then you have committed an assault…
Looking at what assault is as seen above, it could simply be that, all what Mzbel did was to intentionally or recklessly shout out loud or act in a way that the police officer apprehended that Mzbel was going to hit or touch him…
If this happened, then Mzbel has assaulted the police officer according to the law and this can attract a prison sentence even though she might not have physically touched the police officer.
Considering how loosely assault can be committed in our everyday life and the fact that Mzbel is a ‘Celebrity’, do you think even if found guilty, she should be spared prison sentence (and face fines) or she should face the ‘default’ punishment of assault which could probably be ‘3 months’ in prison’?
